1. What MySimpleGallery provides

MySimpleGallery allows users to create private online galleries for events, upload and organise photographs, and share galleries with others using links or QR codes.

Some features are available free of charge, while others require a one-off payment to unlock premium functionality.

2. Accounts and access

You access your MySimpleGallery account using secure email login links.

You are responsible for maintaining the security of your email account and any devices used to access MySimpleGallery. Any activity carried out through your account is your responsibility.

3. Payments

Certain features require a one-off payment per gallery. Prices are displayed clearly before purchase.

Unless explicitly stated otherwise, MySimpleGallery does not operate on a subscription basis.

Payments are processed securely by Stripe. We do not store or have access to your payment card details.

4. Your galleries and uploaded content

You are responsible for all content you upload to MySimpleGallery, including photographs, gallery names, descriptions, cover images, and any other materials.

You confirm that you have the necessary rights or permission to upload and share this content.

You retain ownership of all content you upload.

By using MySimpleGallery, you grant us a limited licence to store, process, display, and transmit your content solely for the purpose of providing and improving the service.

5. Gallery sharing

You control who receives access to your gallery by sharing its unique link or QR code.

Anyone with access to your gallery link may be able to view content within that gallery unless additional access restrictions are enabled.

You are responsible for deciding who you share your gallery with.

6. Acceptable use

You agree not to:

• Use MySimpleGallery for any unlawful or fraudulent purpose.
• Upload content that infringes another person's copyright, privacy, or other legal rights.
• Upload malicious software, viruses, or harmful code.
• Attempt to gain unauthorised access to other users' accounts, galleries, or data.
• Interfere with or disrupt the operation or security of the service.
• Use the service to distribute illegal, abusive, or harmful content.

We reserve the right to remove content or restrict access where we reasonably believe these Terms have been breached.

7. Intellectual property

The MySimpleGallery website, branding, software, design, and underlying technology remain our intellectual property or that of our licensors.

These Terms do not grant you ownership of any part of the MySimpleGallery service itself.

8. Suspension and termination

We may suspend or terminate access to MySimpleGallery where:

• These Terms are breached.
• The service is used unlawfully.
• Continued access poses a risk to the security, integrity, or operation of the service.
• We are required to do so by law.

Where appropriate, we may remove content that violates these Terms.

9. Availability and changes

We aim to keep MySimpleGallery available, secure, and reliable.

However, we cannot guarantee uninterrupted availability or that the service will always be free from errors.

We may modify, improve, replace, or discontinue features at any time.

10. Limitation of liability

MySimpleGallery is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or business losses arising from your use of the service, including loss of data, profits, business opportunities, or goodwill.

Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.

11. Refunds

We want you to have a great experience using MySimpleGallery.

If you experience a technical issue or believe you have been charged incorrectly, please contact us within 7 days of purchase.

Refund requests are considered on a case-by-case basis and may be declined where premium features have already been used extensively or where abuse of the refund policy is suspected.

Nothing in this section affects any statutory rights you may have under applicable consumer protection laws.

12. Privacy

Your use of MySimpleGallery is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

13. Changes to these Terms

We may update these Terms from time to time.

Where changes are significant, we will take reasonable steps to notify users where appropriate. Continued use of MySimpleGallery after updated Terms become effective constitutes acceptance of the revised Terms.

Governing Law
